Terms of Service

1. Introduction and Acceptance
These Terms of Service ("Terms") govern your use of the Open Working Hours mobile application ("App") operated by Lukas Jonathan Hondrich ("we", "us", "our").
By creating an account or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the App.
2. Service Description
Open Working Hours provides:
- A mobile app for tracking working hours using geofencing and manual input
- Calendar functionality for planning shifts and absences
- The ability to confirm and submit daily working hours
- Contribution to anonymized, aggregated statistics about healthcare working conditions
The App is designed for healthcare workers in Germany who wish to track their working hours and contribute to transparent reporting on working conditions in the healthcare sector.
3. Account Registration
To use the App, you must:
- Provide a valid email address for verification
- Complete your profile with your federal state, profession, seniority level, and department group. You may optionally select your hospital.
- Be at least 18 years old or have the legal capacity to enter into this agreement
You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.
4. Consent to Data Aggregation
By using the App and submitting confirmed working hours, you consent to your data being included in aggregated, anonymized statistics. These statistics:
- Contain no personal data that can identify you
- Are only published when groups have at least 5 contributors (k-anonymity, k=5)
- May include aggregations at state level or, where cell sizes permit, at facility level
- May be shared publicly or with healthcare unions, professional associations, and researchers
You may withdraw this consent at any time by deleting your account. Upon deletion, your personal data will be removed, but previously calculated aggregated statistics will be retained as they cannot be linked back to you.
5. Acceptable Use
You agree to:
- Provide accurate information about your working hours
- Use the App only for its intended purpose
- Not attempt to manipulate or falsify data
- Not attempt to reverse-engineer, decompile, or interfere with the App's operation
- Not use the App for any unlawful purpose
We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe are submitting fraudulent data.
6. Data Accuracy and Responsibility
You are responsible for the accuracy of the working hours you submit. The App provides tools (geofencing, calendar) to help you track time, but the final confirmation of daily hours is your responsibility.
The aggregated statistics we publish are based on user-submitted data. We do not independently verify individual submissions. The statistics should be understood as self-reported data from healthcare workers, not officially audited records.
7. Intellectual Property
The App, its design, code, and content are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App without our permission.
The aggregated statistics we produce may be used freely for non-commercial purposes with attribution to Open Working Hours. Commercial use requires our prior written consent.
8. Disclaimer of Warranties
The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee that:
- The App will be available at all times without interruption
- The App will be free of errors or bugs
- The geofencing feature will work perfectly in all locations
- The aggregated statistics will be complete or representative of all healthcare workers
9. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
This includes but is not limited to: damages arising from disputes with your employer about working hours, reliance on aggregated statistics, or any actions taken based on data from the App.
10. Independence from Employers
Open Working Hours is not an employer tool. We have no relationship with your employer. Your employer:
- Cannot access your individual data
- Cannot request access to your data from us
- Has no role in operating or governing this service
This App is designed to empower healthcare workers, not to serve as an employer monitoring system.
11. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the App. Your continued use of the App after changes take effect constitutes acceptance of the new Terms.
12. Termination
You may terminate your account at any time by using the delete account function in the App. We may terminate or suspend your account if you violate these Terms.
Upon termination, your personal data will be deleted in accordance with our Privacy Policy.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.
